These Terms and Conditions outline the rules for purchasing and participating in the online course (hereinafter: "Course") provided through the Easytools platform (hereinafter: "Platform"). Before purchasing the Course, each Participant should carefully review the provisions outlined below. Purchasing access to the Course means accepting these Terms and Conditions.
Participation Conditions
Access based on purchase: The Course is intended solely for individuals who have made a legal purchase. Only Participants who have an active account on the Easytools Platform linked to the completed purchase will gain access to the Course content.
Prohibition of sharing access: Access to the Course is individual. Participants may not share their account or Course materials with third parties. It is prohibited to share login credentials or allow unauthorized individuals to access the purchased Course.
Course Access and Schedule
Platform and access form: The Course is provided online through the Easytools Platform. To access the Course, Participants need a device with an Internet connection and a compatible web browser. Upon purchase, the Participant will receive access to the Course content on their Easytools Platform account..
Course language: The Course materials (e.g., video recordings) are prepared in Polish, with English subtitles available to facilitate understanding for non-Polish speakers.
Schedule of module publication: The first Course module will be made available on June 1, 2025. Subsequent modules are scheduled to be released at weekly intervals. The Organizer will make efforts to stick to the announced schedule but reserves the right for slight delays due to technical or organizational reasons.
Lifetime access: After purchasing the Course, the Participant will receive permanent (lifetime) access to the purchased Course. This means there is no time limit for accessing the Course materials as long as the Course is maintained on the Platform.
Loss of access for violations: If a significant breach of the Terms and Conditions occurs (e.g., dissemination of Course materials without consent), the Organizer has the right to block further access to the Course for that Participant. In such a case, the Participant will not be entitled to a refund.
Payment
Price and one-time fee: The purchase of access to the Course is made through a one-time payment, with the price specified on the Course purchase page. The price is shown in the currency stated in the offer and is inclusive of all applicable taxes (unless stated otherwise).
Payment process: Payment for the Course is handled by an external payment provider integrated with the Easytools Platform. Available payment methods (e.g., credit card, bank transfer) are specified during the checkout process. After successful payment, the Participant will receive a purchase confirmation and access to the Course will be activated.
Transaction security: The payment process is handled by an external operator, ensuring the security of transactions. Financial data (e.g., credit card number) are not shared with the Organizer – they are processed directly by the secure payment gateway of the payment provider.
No transfer of access: The purchased access to the Course is linked to a specific Participant and cannot be transferred to another person. Reselling or transferring access to the Course to another user within the same payment is not allowed.
Withdrawal and Refund Policy
Digital nature of the service – no refunds: Due to the nature of the product (digital content provided online), there is no right of withdrawal or refund after access to the Course has been granted, unless mandatory laws state otherwise. This means that after purchasing and gaining access to the Course materials, the Participant cannot request a refund.
Waiver of the right of withdrawal (for EU consumers): Participants acknowledge that accessing the Course before the statutory withdrawal period results in the loss of the right to withdraw. By purchasing, the Participant gives explicit consent for digital content to be made available immediately after the agreement is concluded (before the 14-day withdrawal period expires) and acknowledges the loss of the right to withdraw from the contract under Art. 38 (13) of the Consumer Rights Act of May 30, 2014.
Exceptions by law: If applicable laws in the consumer’s jurisdiction allow withdrawal or refund in certain cases despite the above provisions (e.g., in certain consumer jurisdictions), those provisions will apply. This refund policy is not intended to limit any statutory consumer rights that cannot be waived or excluded.
Copyright and Use of Course Materials
Protection of Course content: All materials provided as part of the Course (including, but not limited to, video recordings, PDF documents, presentations, textual content, and other resources) are works protected by copyright or other intellectual property rights. Copyright for these materials belongs to the Organizer or its licensors.
License for the Participant: Purchasing access to the Course grants the Participant a non-exclusive, non-transferable license to use the Course materials solely for personal educational purposes. The license does not include the right to publicly share or distribute the materials.
Prohibition of distribution: Copying, distributing, publicly sharing, reproducing, recording, or reselling all or part of the Course materials without the prior written consent of the Organizer is prohibited. Specifically, it is forbidden to upload or share Course materials online (e.g., on social media, file-sharing platforms) or provide them to unauthorized persons.
Measures in case of violations: If a violation of copyright or the Terms and Conditions regarding the prohibition of distributing materials is found, the Organizer has the right to take appropriate legal action, including revoking access to the Course for the Participant with immediate effect, without a right to a refund. The Organizer may also pursue compensation for damages.
Organizer’s Liability
vailability and quality of services: The Organizer makes every effort to ensure that the Course content is available continuously and that the materials are of the highest quality. However, the Organizer is not responsible for temporary interruptions or difficulties in accessing the Course caused by factors outside its control (e.g., failures on the Easytools platform’s side, issues with the Participant’s internet connection or device).
Use of Course knowledge: The content provided in the Course is educational. The Organizer does not guarantee specific results from applying the knowledge gained during the Course. The implementation of the information and advice obtained in the Course is at the Participant’s sole responsibility. The Organizer is not responsible for any direct or indirect damages resulting from the application of the Course knowledge in practice, to the fullest extent permitted by law.
Scope of liability: To the fullest extent permitted by applicable law, the Organizer’s liability to the Participant under this Agreement is limited to the amount paid by the Participant for Course access. This provision does not intend to exclude or limit the Organizer's liability in cases where such liability cannot be excluded or limited by law (e.g., in cases of willful harm).
Final Provisions
Amendments to the Terms and Conditions: The Organizer reserves the right to amend these Terms and Conditions for valid reasons (e.g., changes in the law, changes to the Course’s features, technical changes to the Platform). Participants will be notified of any significant amendments to the Terms and Conditions via a message on the Course page and/or an email sent to the Participant's registered email address. Changes will take effect no earlier than 7 days after notifying Participants. Continued use of the Course after this period indicates acceptance of the updated Terms and Conditions.
Applicable law and jurisdiction: Matters not regulated by these Terms and Conditions shall be governed by the relevant laws of the jurisdiction in which the Organizer is located. These Terms and Conditions and the agreement for purchasing access to the Course are subject to Polish law. However, the provisions of these Terms and Conditions do not exclude or limit the mandatory consumer protection laws of the consumer's country of residence.
Severability of provisions: If any provision of these Terms and Conditions is found to be invalid or ineffective by a final court ruling or a decision by an appropriate authority, this shall not affect the validity or effectiveness of the remaining provisions. In place of the invalid provision, the relevant legal provisions or general principles of law shall apply.
Contact with the Organizer: Any questions or complaints related to the functioning of the Course or the performance of the agreement should be addressed to the Organizer via email at krystian@designsystems.online
Effective date: These Terms and Conditions come into effect on 11.03.2025 and apply to all Course purchases made from that date onwards.
